1Agreement to these terms

These Terms and Conditions apply to the Padel Point app for iPhone, Apple Watch, iPad, and Huawei Watch, created by Frederique De Sousa (“Service Provider”), provided as a free service.

By downloading or using the Application, you agree to be bound by these Terms. If you do not agree, do not download or use the Application.

2License grant

The Service Provider grants you a non-exclusive, non-transferable, revocable, limited licence to use the Application on a device you own or control, strictly in accordance with these Terms and the applicable app store terms (Apple App Store or Huawei AppGallery).

This licence does not include the right to sell, commercially exploit, or transfer the Application to another person.

3Free service

Padel Point is provided entirely free of charge. All features are available to all users at no cost. The Service Provider reserves the right to introduce optional paid features in the future, communicated clearly in advance and never removing access to core free features.

4Restrictions

• Copying, modifying, or distributing the Application or any part of it
• Reverse-engineering, decompiling, or extracting the source code
• Creating derivative works based on the Application
• Removing or obscuring any copyright or trademark notices
• Using the Application for any unlawful purpose
• Attempting to gain unauthorised access to the Application or its infrastructure

All intellectual property rights — including the Padel Point name, logo, design, and code — remain the exclusive property of the Service Provider.

5Modifications to the application

The Service Provider may update, modify, or discontinue the Application at any time. Significant changes will be communicated via app update release notes or in-app messaging.

6Data storage & security

Your match data, settings, and profile information are stored to provide the Application’s features. Please refer to our Privacy Policy for full details.

You are responsible for maintaining the security of your device. We strongly advise against jailbreaking (iOS) or rooting (HarmonyOS) your device.

7Third-party services

The Application integrates with:

• Apple HealthKit / Apple Fitness — workout data recording on Apple Watch
• Huawei Health — workout data recording on Huawei Watch
• Apple App Store — iOS/watchOS distribution
• Huawei AppGallery — HarmonyOS distribution

Your use of these services is subject to their respective terms and privacy policies. The Service Provider is not responsible for the practices of these third-party services.

8Internet connectivity & charges

Some features require an active internet connection. You are responsible for any data charges from your mobile carrier, including roaming. Ensure you have the permission of the bill payer if you are not the account holder.

9Device responsibility

You are responsible for keeping your device charged. The Service Provider accepts no responsibility if the Application becomes unavailable due to a depleted battery. We recommend keeping your device software up to date for the best experience.

10Accuracy & updates

While we strive for accuracy, the Service Provider does not warrant that all information in the Application is always accurate or current. Updates may be required to continue using the Application. The Application may be terminated at any time without prior notice.

11Limitation of liability

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for:

• Indirect, incidental, or consequential damages from your use of the Application
• Inaccuracies in score tracking, health metrics, or tournament results
• Loss of data, profits, or business opportunities
• Any injury or harm from physical activity undertaken while using the Application

The Application is a sports scoring aid. It is not a medical device. Health data should not replace professional medical advice.

12Governing law

These Terms are governed by the laws of the United Arab Emirates. EU consumers also benefit from mandatory protections under their applicable national law; nothing in these Terms limits those rights.

13Changes to these terms

We may update these Terms periodically. The “Last updated” date reflects the most recent revision. Continued use after changes are posted constitutes acceptance.

4使用限制

• 复制、修改或分发本应用或其任何部分
• 对源代码进行逆向工程、反编译或提取
• 基于本应用创建衍生作品
• 移除或遮盖任何版权或商标声明
• 将本应用用于任何非法目的
• 尝试未经授权访问本应用或其基础设施

所有知识产权 — 包括 Padel Point 名称、标志、设计及代码 — 均为服务提供者的专有财产。

5应用程序的修改

服务提供者可能随时更新、修改或终止本应用。重大变更将通过应用更新说明或应用内消息通知。

6数据存储与安全

您的比赛数据、设置及个人资料信息会被存储，以便提供本应用的功能。详情请参阅我们的隐私政策。

您需负责维护设备的安全性。我们强烈建议不要对 iOS 设备进行越狱（jailbreak）或对 HarmonyOS 设备进行 root 操作。

7第三方服务

本应用集成了以下服务：

• 华为运动健康 — 在华为手表上记录运动数据
• Apple HealthKit / Apple Fitness — 在 Apple Watch 上记录运动数据
• 华为应用市场 — HarmonyOS 分发渠道
• Apple App Store — iOS/watchOS 分发渠道

您对这些服务的使用受其各自条款及隐私政策的约束。服务提供者不对这些第三方服务的行为负责。

8网络连接与费用

部分功能需要有效的互联网连接。您需自行承担来自您移动运营商的任何数据费用，包括漫游费用。如果您不是账户持有人，请确保已获得账单支付人的许可。

9设备责任

您需负责为设备保持电量充足。如因设备电量耗尽导致本应用无法使用，服务提供者不承担任何责任。我们建议您将设备软件保持最新，以获得最佳体验。

10准确性与更新

尽管我们力求准确，但服务提供者不保证本应用中的所有信息始终准确或最新。可能需要更新才能继续使用本应用。本应用可能随时终止，无需提前通知。

11责任限制

在适用法律允许的最大范围内，服务提供者对以下情形不承担责任：

• 因使用本应用而产生的间接、附带或后果性损害
• 比分记录、健康指标或比赛结果中的不准确之处
• 数据、利润或商业机会的损失
• 在使用本应用期间进行体育活动而导致的任何伤害或损害

本应用是一款体育计分辅助工具，并非医疗设备。健康数据不能替代专业医疗建议。

12适用法律

本条款受阿拉伯联合酋长国法律管辖。欧盟消费者依然享有其适用国家法律赋予的强制性保护，本条款的任何内容均不限制该等权利。

中国大陆用户依然享有《中华人民共和国消费者权益保护法》《网络安全法》《数据安全法》及《个人信息保护法》等适用法律赋予的强制性保护，本条款的任何内容均不限制该等权利。

13条款变更

我们可能会定期更新本条款。"最后更新"日期反映最新修订。变更公布后继续使用即表示您接受这些变更。

生效日期：2025年5月1日。最后审阅日期：2026年6月。
